Distance Sales Agreement

This Distance Sales Agreement is concluded electronically between CVfive (Seller) and the registered user who purchases the relevant service (Buyer) under the Turkish Consumer Protection Law No. 6502 and the Regulation on Distance Contracts.

1. Seller Information

Seller: CVfive (cvfive.com). Contact: hello@cvfive.com.

2. Buyer

The Buyer is the registered user who completes the purchase transaction through the platform.

3. Subject of Agreement

The subject of this agreement is the sale and delivery of digital services offered by CVfive, namely Pro Plan digital subscription and/or digital credits used within the CVfive service.

4. Product/Service Details

Pro Plan is a monthly recurring subscription. Service scope and current fees are shown to the Buyer during checkout and before payment approval.

5. Payment

Payments are processed by Lemon Squeezy as Merchant of Record. Accepted payment methods include credit and debit cards.

6. Delivery

Digital delivery is made immediately after payment confirmation. No physical shipment or physical delivery is provided.

7. Right of Withdrawal (14 Days)

Under Law No. 6502 and the Regulation on Distance Contracts, the Buyer has the right to withdraw within 14 days from the purchase date. However, for digital content/services, if performance begins with the Buyer's explicit consent and acknowledgment that the right of withdrawal is lost after access starts, the withdrawal exception applies. By completing the purchase, the Buyer acknowledges that this exception applies to credits and digital content used immediately.

8. Unused Pro Subscription Within 14 Days

If Pro subscription access has not been used, the Buyer may exercise the withdrawal right within 14 days by contacting hello@cvfive.com.

9. Cancellation

Pro subscriptions may be canceled at any time through account settings. If canceled, access continues until the end of the current billing period.

10. Dispute Resolution

For disputes up to the statutory monetary threshold, Turkish Consumer Arbitration Committees are competent. For disputes above that threshold, Istanbul Consumer Courts are competent.

11. Governing Law

This agreement is governed by the laws of the Republic of Turkiye, including Turkish Consumer Protection Law No. 6502 and related secondary legislation.

Mesafeli Satış Sözleşmesi

İşbu Mesafeli Satış Sözleşmesi, CVfive (Satıcı) ile ilgili hizmeti satın alan kayıtlı kullanıcı (Alıcı) arasında 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği uyarınca elektronik ortamda kurulmuştur.

2. Alıcı

Alıcı, platform üzerinden satın alma işlemini tamamlayan kayıtlı kullanıcıdır.

3. Sözleşmenin Konusu

Bu sözleşmenin konusu, CVfive tarafından sunulan Pro Plan dijital aboneliği ve/veya CVfive hizmetinde kullanılan dijital kredilerin satışı ve teslimidir.

4. Ürün/Hizmet Bilgileri

Pro Plan aylık yenilenen abonelik modelidir. Hizmet kapsamı ve güncel ücretler, ödeme onayı öncesinde Alıcı'ya ödeme ekranında gösterilir.

5. Ödeme

Ödemeler, Merchant of Record sıfatıyla Lemon Squeezy tarafından tahsil edilir. Kabul edilen ödeme yöntemleri kredi kartı ve banka kartıdır.

6. Teslimat

Dijital teslimat, ödeme onayının alınmasını takiben derhal gerçekleşir. Fiziksel ürün gönderimi veya fiziksel teslimat yoktur.

7. Cayma Hakkı (14 Gün)

6502 sayılı Kanun ve Mesafeli Sözleşmeler Yönetmeliği kapsamında Alıcı, satın alma tarihinden itibaren 14 gün içinde cayma hakkına sahiptir. Ancak dijital içerik/hizmetlerde, ifaya Alıcı'nın açık onayı ve cayma hakkını kaybedeceğine dair bilgilendirmeyi kabul etmesiyle başlanmış ise cayma hakkı istisnası uygulanır. Satın alma işleminin tamamlanmasıyla Alıcı, derhal kullanılan kredi ve dijital içerikler açısından bu istisnanın geçerli olduğunu kabul eder.

8. 14 Gün İçinde Kullanılmamış Pro Abonelik

Pro abonelik hakkı kullanılmamış ise Alıcı, 14 gün içinde hello@cvfive.com adresi üzerinden başvurarak cayma hakkını kullanabilir.

9. İptal

Pro abonelikleri hesap ayarları üzerinden her zaman iptal edilebilir. İptal halinde erişim, mevcut faturalandırma dönemi sonuna kadar devam eder.

10. Uyuşmazlıkların Çözümü

Kanuni parasal sınır altındaki uyuşmazlıklarda Tüketici Hakem Heyetleri görevlidir. Sınırın üzerindeki uyuşmazlıklarda İstanbul Tüketici Mahkemeleri yetkilidir.

11. Uygulanacak Hukuk

İşbu sözleşme, 6502 sayılı Tüketicinin Korunması Hakkında Kanun ve Mesafeli Sözleşmeler Yönetmeliği dahil olmak üzere Türkiye Cumhuriyeti hukukuna tabidir.
